Violations Subject to Permanent Exclusion & Expulsion for One Year

 

                Violation by a student of any one or more of the following rules of conduct will result in disciplinary action, such as permanent exclusion, one year expulsion for carrying dangerous weapons, regular expulsion, suspension, emergency removal and/or referral to juvenile or municipal court.  Alternative types of disciplinary action such as parental contact, in-school suspension, detention, community service and reprimand may be also issued by administrators.

 

Permanent Exclusion

 

1.        When a student who is age sixteen (16) or over commits one of several crimes listed under

Ohio Revised Code Section 3313.662 (A), the State Superintendent of Public Instruction may issue an adjudication order that permanently excludes a pupil from attending any of the public schools of this state.

 

2.        The offenses for which permanent exclusion is authorized are as follows:

 

a.        conveying deadly weapons onto school property or to a school function,

 

b.       possessing deadly weapons on school property or at a school function,

 

c.        carrying a concealed weapon on school property or at a school function,

 

d.       trafficking in drugs on school property or at a school function,

 

e.        murder or aggravated murder on school property or at a school function,

 

f.         voluntary or involuntary manslaughter on school grounds or at a school function,

 

g.       assault or aggravated assault on school grounds or at a school function,

 

h.       rape, gross sexual imposition, or felonious sexual penetration on school grounds, at a school function, or when the victim is a school employee,

 

i.         complicity in any of the above offenses, regardless of location.

 

Expulsion For One Calendar Year Or Longer

Dangerous Weapons

 

                The Superintendent of the Ironton City School District shall expel a pupil from school for one (1) calendar year for bringing a firearm or dangerous weapon to a school operated by the Board of Education or on to any other property owned or operated or controlled by the board, except that the Superintendent may reduce this requirement on a case-by-case basis in accordance with this code of conduct.

               

                The Superintendent may grant an expulsion reduction after fully investigating the circumstances surrounding the possession of the firearm or dangerous weapon.  Reasons for reducing the penalty may include mitigating circumstances beyond the control of the pupil, threats of bodily harm, or loss of life, and unintentional possession such as placement by another pupil.

 

                Community service may not be substituted for explusion under this category.

 

                A student expelled will be removed from the student’s regular school setting; however, the board may provide educational services to the student if recommended by the Superintendent.

 

                Any student expelled for weapons violations will be referred to the criminal justice or the juvenile justice system.
